Terms and Conditions of Use

  1. Definitions
  • Company: The company MCAudioLab, registered as MCA Trade in Warsaw, Poland, hereinafter referred to as “MCA.”
  • Address: Bernardynska 12, 02904, Warsaw, Poland.
  • Buyer: Any individual, company, or legal entity that places an order accepted by MCA.
  • Website: The official website of MCA, accessible at www.mcaudiolab.com.
  1. General Terms All orders placed on the Website are governed by these Terms and Conditions. No other terms or conditions shall apply unless explicitly agreed upon by MCA in writing.
    MCA reserves the right to modify these Terms and Conditions at any time. In such cases, the version of the Terms and Conditions applicable at the time of the buyer’s order will apply.
    MCA also reserves the right to refuse to engage in business with any individual or entity.

 

  1. Products The products available for purchase are those listed on the Website.
    Product availability is subject to stock levels.
    While MCA makes efforts to accurately describe products and services, these descriptions are approximate and do not form part of the contract between MCA and the Buyer. MCA reserves the right to correct any errors on the Website without liability to the Buyer.
    MCA may discontinue products or modify their design without prior notice, as part of its continuous product improvement.
  1. Prices
  • All prices are in Euros and exclude Polish VAT (23%).
  • The price including 23% VAT will be shown for customers purchasing items without a VAT ID (private customers).
  • Product prices are as displayed on the Website at the time of the Buyer’s order.
  • MCA reserves the right to change prices at any time without notice.
  • Shipping costs are not included in the product prices and will be added and calculated during the checkout process.
  • Import duties and taxes are not included in the prices and are the Buyer’s responsibility.
  • EU-based businesses with a valid VAT number can request a VAT-exempt invoice.
  1. Ordering Process

To place an order, the Buyer must:

  1. Select desired products on the Website and add them to the cart.
  2. Proceed to checkout and fill in personal and/or company information. The Buyer can include special instructions in the “Additional Information” field.
  3. Shipping costs will be calculated based on the shipping destination.
  4. Review the order details and Check the “Terms and Conditions” check box. The checkmark on the “Terms and Conditions” implies that the user has read, understood, and accepted the terms and conditions clearly outlined in this document.
  5. Proceed with the payment.
  6. The customer will be informed about the purchase result by email.
  7. The order will be considered correctly placed if the payment is successfully processed and the verification of any (optional) company data is valid.
  1. Right of Refund Policy
  • The Buyer (consumer only) has the right to return purchased products within 14 days of delivery for an exchange or refund, at their own cost and risk. The goods must be in their original condition and packaging.
  • If the product was purchased as a kit, it must be returned in its original, unassembled state, and complete with all parts included. Partial returns or items with replaced, tampered, or modified parts will not be accepted. The product should be returned in the same condition as it was received.
  • Shipping costs and any transaction fees will be deducted from the refund.
  • Returns will not be accepted without prior approval from MCA via email.
  1. Payment
  • Payment is due at the time of order.
  • The payment method is PayPal. Credit card payments are processed through PayPal if the portal accepts this option.
  • The Buyer’s account will be charged immediately upon order confirmation. Products will be shipped within 2 to 5 business days, depending on the billing process and documents to prepare.
  • A supplementary payment may be required if the Buyer has provided inconsistent or incorrect data, including fiscal information. The ordered goods will remain on hold until the required additional information is received.
  • The Buyer may still cancel the order as long as it has not yet been shipped.
  • A PDF invoice (if required) will be sent to the Buyer via email.
  1. Delivery
  • The delivery will be made to the address specified by the Buyer during checkout.
  • The Buyer should inspect the package in the presence of the delivery person. If the package is damaged, the Buyer may refuse the delivery or file a claim.
  • If damages are discovered after delivery, the Buyer must send a written claim to the carrier within 3 days and inform MCA within the same period.
  • Any incorrect deliveries may be returned to MCA, which will either replace the products or issue a refund. No returns will be accepted without prior agreement from MCA.
  • Delivery times are set by the courier. MCA is not liable for delivery times or delays.
  1. Risk and Ownership
  • The risk of loss or damage to the products passes to the Buyer upon delivery.
  • Ownership of the products remains with MCA until full payment is received.
  1. Repairs
  • If the Buyer encounters issues with a kit and is unable to make it work, MCA offers a repair service. The diagnostic is free, but the cost of repairs will be charged based on hourly rates and any necessary replacement components.
  • Shipping costs for repairs are the responsibility of the Buyer.
  • The repair service is subject to part availability and is only available if the product has not been physically or electrically damaged or modified.

  1. Warranty
  • MCA offers a warranty for all products it delivers. If any product is found to be defective, MCA will repair, replace, or refund the product after conducting an inspection.
  • The warranty applies only to products manufactured and tested by MCA and only if they have been used according to the instructions provided on the Website.
  • The warranty does not cover defects resulting from improper use or failure to follow the product instructions.
  • This warranty does not apply to kits assembled by the Buyer.
  • Claims under warranty must be made in writing within 12 months from the delivery date. All shipping costs for warranty claims are the responsibility of the Buyer.
  1. Intellectual Property
  • MCA retains all intellectual property rights in the content of the Website. Unauthorized reproduction or use of the content, in whole or in part, is prohibited.
  1. Privacy Policy
  • MCA does not share Buyer information with third parties, except when required for order fulfillment. In such cases, the third parties are prohibited from further sharing the information.
  • Cookies are used to enable essential website functionality, such as navigating and tracking the contents of your cart. Disabling cookies may prevent you from placing orders or using certain features.
  • Data collected is used solely to process orders and to share information with third parties necessary for delivery.
  1. Governing Law and Jurisdiction
  • These Terms and Conditions are governed by Polish law.
  • Any disputes arising under these Terms shall be subject to the jurisdiction of the courts located in Warsaw, Poland.
